  • This seminar reviews the Ontario Family Law Act and the legal, financial and taxation aspects of marriage, separation and divorce. The definitions and rules applicable to family property, the matrimonial home, child and spousal support obligations and domestic contracts are examined in some detail. The income tax rules and planning opportunities are also an aspect of this seminar.

    The detailed implications of income tax and marital breakdown are more fully reviewed in the Family Law and the Income Tax Act seminar. Two instructors, a tax partner with a national firm, and a family law lawyer, will present this informative full-day course.

    • Legal framework for family law (somewhat specific to Ontario)
    • Definitions within the Act (spouse, separation, property, support)
    • Family property - valuation, excluded property and the equalization process
    • The new “Pension Splitting” rules
    • Matrimonial home and the differences between married and unmarried couples
    • Support obligations – child and spouse
    • Domestic contracts – what can and cannot be covered in one
    • The Income Tax Act and implications of separation
    • Planning considerations in a corporate setting

    SPEAKER(S) BIO

    Terry Hainsworth practised law for 42 years in London. Over the years he has taught at the University of Western Ontario's law school and the Ontario Bar Admission course. He is a frequent lecturer at continuing education programs for the Canadian Bar Association and the Law Society of Upper Canada. He is the author of several textbooks on Family Law widely used by family law lawyers throughout Canada. He now practices as a Family Law Mediator and Arbitrator.

    Douglas Plummer, CPA, CA is a Tax partner with BDO in London Ontario. Doug has over 30 years of public practice tax experience; working in several offices that tend to focus on owner managed enterprises. Along with his ongoing income tax specialization, he is also involved in commodity tax issues, estate planning, and family law matters. Doug has also taught tax courses at the University level, and has presented a number of courses for CPA Ontario, at the School of Accountancy, as well as for all three predecessor bodies over the past 25 years.
